In particular, data is protected against unauthorized access, collection, processing, loss, alteration, damage, or destruction by unauthorized persons. - The Customer using the Seller's services provided via the Online Store is obliged to comply with these Terms and Conditions to the extent necessary for the fulfillment of the placed order and not contrary to applicable law and social norms.
- The Seller fulfills orders within Poland and orders placed by Consumers in Europe, and after prior agreement on delivery terms, also in other countries.
- All Goods available for sale in the Online Store have been legally introduced to the Polish market and comply with legal regulations. Information about the Goods on the Online Store's website constitutes an invitation to conclude an agreement within the meaning of Article 71 of the Act of April 23, 1964, Civil Code.
- NOTE: The prices of Goods listed on the Online Store's website do not include delivery costs, which are added at the stage of selecting the delivery method by the Customer.
§3 Terms of Service
- This Online Store provides services electronically. The condition for entering into an agreement is primarily the completion of the online order form to conclude a sales agreement. Entering into the agreement is voluntary.
- Product Reviews. The Buyer receives an invitation to leave a review of the products at the email address provided during the order process. From the provided email address, the Buyer is redirected to a form where they can leave a review. The review is automatically displayed on the store's website in the "reviews" section on the product page and on the page https://www.zlocisto.pl/opinie_klientow.
- Website Reviews. The Buyer receives an invitation to leave a review of the website at the email address provided during the order process. From the provided email address, the Buyer is redirected to a form where they can leave a review. The review is automatically displayed on the website in the "reviews" section, randomly on the store's homepage, and on the page https://www.zlocisto.pl/opinie_klientow.
- The service agreement is concluded electronically by enabling the Customer of the Online Store to complete the order form. The agreement is concluded for a fixed period at the moment the Customer begins completing the form and is terminated upon withdrawal from completing the form or upon submission of the completed form to the Seller. The process of completing the order form is organized in such a way that every Customer has the opportunity to review it before deciding to conclude the agreement or make changes to the agreement.
- The service specified in point 1 is provided free of charge; however, it may require access to the Internet.
- Orders can be placed electronically 24 hours a day, 7 days a week.
- When finalizing the purchase, the Customer marks the option "I consent to the processing of my personal data contained in the order form by the store for the purpose and scope necessary to fulfill the order." – this is necessary to conclude the agreement. Providing personal data is required to place an order; failure to provide personal data will be equivalent to withdrawing from concluding the agreement.
- In accordance with Article 8(2) of GDPR, the administrator, taking into account available technology, makes reasonable efforts to verify whether the person exercising parental authority or custody over a child (under 16 years of age) has given or approved consent.
- The Customer bears all costs related to Internet access and data transmission in accordance with the tariff of their service provider, with whom the Customer has signed an agreement for Internet services.
§4 Terms of Agreement
- To conclude a valid and binding Sales Agreement, the Customer selects the Goods in accordance with the offer displayed on the Online Store, specifying the quantity of Goods they intend to purchase and, if applicable, indicating the features of the ordered Product and its specifications. Along with selecting the Goods, the Customer completes the online order form, providing the information necessary for the Seller to fulfill the order, such as the quantity, delivery address, and payment method, based on the messages and information displayed to the Customer on the website and contained in these Terms and Conditions.
- Registering a Customer Account in the Online Store is voluntary and free of charge. The Customer may make a purchase after registering an account or without registration (as a "guest").
- Immediately after receiving the order, the Seller sends the Customer, via email to the address provided during the order process, a statement confirming receipt of the order, which also serves as confirmation of the order. Upon receipt of this message by the Customer, the Sales Agreement is concluded.
- The summary and confirmation message of the order contains all previously agreed terms of the Sales Agreement, including the quantity and type of ordered Goods, their specifications in the case of Goods with individual characteristics specified by the Customer in the Online Store, the total price to be paid (specified in Polish zlotys), including delivery costs and the amount of any discounts granted (if applicable).
- If the Customer has multiple discounts from various sources/promotions, they can only be combined/summed if explicitly stated in the Promotion Terms and Conditions. If there is no provision regarding the combination of different promotions/discounts, only one discount (one promotion) can be selected for a given purchase.
§5 Order Fulfillment
- The Seller diligently fulfills the Customer's orders in the order they are received – every order is a priority and very important to us!
- The order fulfillment time for an individual Customer varies depending on the ordered product. The vast majority of products are shipped within 1 business day from the moment the Customer places the Order. For products such as rings or wedding bands, the delivery time may be longer, but it is always specified on the product page. The order fulfillment time primarily includes the time required to prepare the order (completing and packing the order, handing it over to the courier, and, in selected cases, manufacturing or engraving the Goods). The delivery time depends on the chosen delivery method and may vary depending on the type of transport selected by the Customer.
- In the event of exceptional circumstances or the inability to fulfill the order within the time specified in point 2, the Seller will promptly contact the Customer to determine the next steps, including setting a new order fulfillment date, changing the delivery method, or possibly offering an alternative product for the fastest possible delivery.
§6 Delivery
- Delivery of Goods within Poland is carried out via courier companies DPD and Inpost. For international shipments, it is possible to send the package via other courier companies such as DHL, FEDEX, or UPS, and their availability is displayed during the selection of the delivery option at the order placement stage, depending on the selected delivery country.
- Please note that we do not use the services of Poczta Polska (Polish Post), and therefore it is not possible to send Goods via this operator.
- Ordered Goods are delivered according to the Customer's choice:
- directly to the Customer's address,
- to a DPD parcel locker or pickup point,
- to an Inpost parcel locker or pickup point,
- to the Seller's personal pickup point, which is the ZŁOCISTO jewelry store located at Mickiewicza Street 14 in Wołomin (05-200).
- The Customer is continuously informed about the delivery costs, which are provided during the completion of the online order form. The shipping costs depend on the country to which the order is being sent, the quantity of ordered Goods, and their weight.
- Personal pickup at the store is possible on business days from 10:00 AM to 6:00 PM and on Saturdays from 9:00 AM to 2:00 PM, after the Customer has received a message confirming that the package is ready for pickup. The Customer selects the delivery method in the online order form and confirms it during the order process. The Goods are always packaged in a manner appropriate to their properties to prevent damage, loss, or destruction during transport.
§7 Payment Methods
- The Seller allows payment for the ordered Goods in the form of a prepayment to a bank account.
- Electronic payment by credit card (Visa, Visa Electron, MasterCard, Maestro) or online banking transfer via the Przelewy24 online payment service, including options such as BLIK, Apple Pay, and Google Pay.
- Cash on delivery of the ordered Goods (cash on delivery) – the Customer pays the courier upon receiving the ordered Goods delivered by the courier company to the address specified by the Customer in the order. Cash payment is also possible at the Seller's address: ZŁOCISTO, Mickiewicza Street 14, 05-200 Wołomin.
Note: Cash on delivery is excluded for certain items made to order, such as gold wedding bands.
§8 Warranty
- Delivery of Goods under the warranty for defects is carried out at the Seller's expense.
- The Seller is liable under the warranty if a defect is found within two years from the date the Goods were delivered to the Consumer. The Seller is liable to the Consumer if the Goods, at the time of delivery, do not conform to the agreement or have physical or legal defects. The Seller is responsible for the non-conformity of the Goods with the agreement if it is discovered within two years from the date of delivery to the Buyer. In the case of replacement of the Goods, this period starts anew. A physical defect means the non-conformity of the sold item with the agreement. In particular, the sold item is non-conforming with the agreement if:
- it does not have the properties that such an item should have due to the purpose specified in the agreement or resulting from circumstances or its intended use;
- it does not have the properties that the Seller assured the Buyer of, including by presenting a sample or model;
- it is not suitable for the purpose that the Buyer informed the Seller of when concluding the agreement, and the Seller did not raise any objections to such use;
- it was delivered to the Buyer in an incomplete state.
- Complaints regarding defects in the Goods should be sent electronically to the Seller's email address or in writing to the Seller's postal address (see §1 point 3: "Seller's Address"). If the Consumer has difficulties and does not know how to construct a complaint regarding defects in the Goods, they may use the form provided as Annex 2 to these Terms and Conditions. This is solely a facilitation for the complaint process and is not a requirement for the effectiveness of the complaint.
- If necessary for the proper assessment of physical defects in the Goods, upon request and after initial arrangements with the Seller, the Goods should be delivered to the Seller's address (see §1 point 3: "Seller's Address") if the nature of the Product allows it.
- The Seller will respond to the Consumer's complaint promptly, but no later than within 14 calendar days from the date of receipt. Failure to respond to the complaint within the specified period is equivalent to its acceptance by the Seller and acknowledgment as justified.
- The Seller covers the costs of collecting the Goods, delivery, removal of defects, or replacement of the Goods with new ones.
§9 Withdrawal
- In accordance with the law, the Customer who is a Consumer, as defined in Article 27 of the Act of May 30, 2014 (Journal of Laws of 2014, item 827, as amended) on Consumer Rights, has the right to withdraw from a distance agreement without giving any reason.
- The right to withdraw from the agreement applies within 14 calendar days from the moment the Goods are taken into possession by the Customer who is also a Consumer or by a third party indicated by the Customer other than the carrier.
- When the Customer who is a Consumer withdraws from the agreement, the agreement is considered not concluded, and the Consumer is released from all obligations. What the parties have provided to each other must be returned in an unchanged state unless the change was necessary within the limits of ordinary management. The return should take place immediately, no later than within fourteen days.
- The Customer who is a Consumer may withdraw from the agreement by submitting a statement using the online form provided as Annex 1 to these Terms and Conditions, sending it electronically or to the Seller's postal address, as chosen by the Customer. Annex 1 is only an aid for withdrawing from the agreement and is not a mandatory template for exercising the right of withdrawal. The Customer may, but is not required to, use it. For effective withdrawal, it is sufficient to send a written statement to the Seller's address along with the returned product.
- Participation in the loyalty program extends the possible return period.
- To meet the deadline specified in point 2, it is sufficient to send the Customer's statement of withdrawal from the agreement before its expiration.
- The Seller will promptly confirm receipt of the Customer's statement of withdrawal from the agreement and appropriately inform the Customer about further proceedings, including the method of returning the Goods, and will answer any questions.
- The Seller will promptly, no later than within 14 calendar days from the date of receipt of the Customer's statement of withdrawal from the agreement, refund all payments received from the Customer, including the costs of delivering the item. The Seller will refund the payment using the same payment method used by the Customer unless the Customer explicitly agrees to a different refund method that does not involve any costs for them.
- If the Seller, with the Customer's consent, has not undertaken to collect the Goods from the Customer, the Seller may withhold the refund of payments received, including the costs of delivery, until the Goods are returned or the Customer provides proof of their return, whichever occurs first.
- The Customer is obliged to return the Goods to the Seller or hand them over to a person authorized by the Seller without delay, but no later than within 14 calendar days from the day they withdrew from the agreement, unless the Seller has proposed to collect the Goods themselves. To meet the deadline, it is sufficient to send the Goods back before its expiration.
- The Customer who is a Consumer bears only the direct costs of returning the Goods.
- The Consumer has the right to withdraw from a distance agreement without giving any reason and without incurring costs, except for the costs specified in Articles 33 and 34 of the Consumer Rights Act.
- The Goods should be delivered to the Seller's Address (see §1 point 3: "Seller's Address").
- The Consumer is responsible for any reduction in the value of the Goods resulting from their use in a manner exceeding what is necessary to determine their nature, characteristics, and functioning. This means that the Buyer has the right to evaluate and check the Goods, but only in a way that would be possible in a physical store (i.e., checking their completeness and technical parameters). The Consumer may not normally use the Goods; otherwise, upon withdrawal from the agreement, they may be charged additional costs related to the reduction in value.
- The right to withdraw from the agreement does not apply to the Customer in relation to agreements specified in Article 38 of the Act of May 30, 2014, on Consumer Rights, including situations where:
- the service has been fully performed with the Consumer's explicit consent, who was informed before the service began that they would lose the right to withdraw from the agreement once the service was fully performed;
- the price or remuneration depends on fluctuations in the financial market that are beyond the Seller's control and may occur before the withdrawal period expires;
- the subject of the service is a non-prefabricated item, made to the Consumer's specifications or serving to meet their individualized needs;
- the subject of the service is an item that is liable to deteriorate quickly or has a short shelf life;
- the subject of the service is an item delivered in a sealed package, which cannot be returned after opening due to health protection or hygiene reasons, if the package was opened after delivery;
- the subject of the service is items that, after delivery, are inseparably combined with other items due to their nature.
§10 Complaint Procedure
- To properly file a complaint, the Customer should provide their details, such as: name and surname or company name, residential address or company headquarters address, and email address, the subject of the complaint, if possible, the order number, along with the time period the complaint concerns, and the circumstances justifying the complaint (a description of the issue), or what features the ordered Goods lack that, according to the Seller's assurances or the way they were presented to the Customer, they should have had. If the Consumer has difficulties and does not know how to construct a complaint regarding defects in the Goods, they may use the form provided as Annex 2 to these Terms and Conditions. This is solely a facilitation for the complaint process and is not a requirement for the effectiveness of the complaint.
- If the Customer is a Consumer, they may request the replacement of the Goods with ones free of defects instead of the remedy proposed by the Seller, or instead of replacing the Product, they may request the removal of the defect, unless bringing the item into conformity with the agreement in the manner chosen by the Customer is impossible or would involve excessive costs compared to the method proposed by the Seller. When assessing the excessiveness of costs, the value of the defect-free item, the type and significance of the identified defect, and the inconvenience to the Customer caused by an alternative method of resolution are taken into account.
- Unless otherwise provided by separate regulations, the entrepreneur is obliged to respond to the Consumer's complaint within 14 days from the date of its receipt. If the entrepreneur does not respond to the complaint within the specified period, it is considered that the complaint has been accepted. The response to the complaint is provided to the Consumer in writing or on another durable medium (e.g., USB drive or CD/DVD).
- A claim regarding withdrawal from the agreement, if not resolved within the specified period, does not equate to the acceptance of the submitted complaint.
§11 Liability
- The Customer is not entitled to:
- post personal data of third parties or distribute images without the required permission or consent of the third party concerned;
- post content of an advertising and/or promotional nature that is inconsistent with the purpose of the store's operations.
- It is prohibited for the Customer to post content, in particular:
- with the intent to violate the personal rights of third parties;
- posted in bad faith or that could be considered as such;
- that would infringe the rights of third parties, including copyrights, related rights, industrial property rights, trade secrets, or confidentiality clauses, especially those classified as secret or strictly confidential;
- containing offensive or threatening language directed at others, or statements commonly considered offensive, such as vulgarities;
- that would harm the legitimate interests of the Seller;
- sending or posting unsolicited commercial information (spam) within the Online Store;
- that would otherwise violate good practices, applicable laws, social norms, or customs.
- Upon receiving a notification from a third party, an authorized entity, or a state authority, the Seller reserves the right to modify or remove content posted by the Customer if it is found to violate these Terms and Conditions or applicable laws. The Seller does not monitor posted content on an ongoing basis.
§12 Out-of-Court Complaint and Claim Resolution Methods
- Information on out-of-court complaint and claim resolution methods, as well as access to these procedures, is available at the offices and websites of district (municipal) Consumer Ombudsmen, social organizations whose statutory tasks include Consumer protection, Provincial Trade Inspection Inspectorates, and at the following addresses of the Office of Competition and Consumer Protection:
- The Consumer has the following options, among others, for out-of-court complaint and claim resolution:
- submitting a request to the Provincial Trade Inspection Inspector to initiate mediation proceedings for an amicable resolution of the dispute;
- submitting a request to the permanent Consumer Arbitration Court operating at the Provincial Trade Inspection Inspector to resolve the dispute arising from the concluded agreement, address: www.uokik.gov.pl/wazne_adresy.php;

- For cross-border disputes, the European Consumer Centres Network (ECC-Net) provides assistance. Addresses of these institutions are available on the European Consumer Centre's website: www.konsument.gov.pl.
- The Consumer may also use the online dispute resolution platform (ODR platform) in accordance with Regulation (EU) No 524/2013 of the European Parliament and of the Council of May 21, 2013, on online dispute resolution for Consumer disputes and amending Regulation (EC) No 2006/2004 and Directive 2009/22/EC (ODR Regulation). The ODR platform is available at: http://ec.europa.eu/consumers/odr/. The European ODR platform provides a single point of access for Consumers and traders to resolve disputes concerning contractual obligations arising from online sales agreements: https://webgate.ec.europa.eu/odr/main/index.cfm?event=main.home.show&lng=PL.
- Using out-of-court complaint and claim resolution methods is voluntary and may only occur if both parties to the dispute, i.e., the Seller and the Customer, agree to it.
§13 Provisions for Entrepreneurs
- The regulations and provisions in this section apply exclusively to Customers and Service Recipients who are not Consumers.
- The Seller reserves the right to withdraw from the sales agreement concluded with a Customer who is not a Consumer within 14 calendar days from the date of its conclusion. Withdrawal from the sales agreement may occur without providing a reason and does not entitle the non-Consumer Customer to any claims against the Seller.
- In the case of returns during the loyalty program, the return period for mutual benefits may be extended.
- The Seller has the right to limit the available payment methods to several or one for specific or all Goods. The Seller may require full or partial prepayment, regardless of the chosen payment method and the fact of concluding the sales agreement.
- The risk of accidental loss or damage to the product passes to the Buyer upon the Seller handing over the ordered product to the carrier. At the moment the ordered product is handed over to the carrier, all benefits and burdens associated with the Goods also pass to the non-Consumer Customer. The Seller is not liable for loss, shortage, or damage from the moment the carrier takes possession of the product until it is delivered to the Customer.
- A non-Consumer Customer is obliged to inspect the shipment in a manner customary for such shipments. If they find that there has been a loss or damage to the product during transport, they are required to take all necessary actions to establish the carrier's liability.
- The Seller informs that, in accordance with Article 558 § 1 of the Civil Code, liability under the warranty for the product towards a non-Consumer Customer is excluded.
- The Seller's liability is limited, both for individual claims and for all claims in total, to the amount paid. The Seller is only liable for typical damages foreseeable at the time of concluding the agreement and is not liable for lost profits.
- All disputes between the Online Store and a non-Consumer Customer will be submitted to the court competent for the Seller's registered office.
§14 Final Provisions
- The Online Store honors all rights of Customers provided for by applicable law.
- If applicable law grants Consumers more favorable mandatory and required legal regulations than those contained in these Terms and Conditions, the relevant provisions of the Terms and Conditions are directly replaced by specific norms of applicable law and are binding on the aforementioned owner.
- All content posted on the Online Store's website (including graphics, texts, page layout, and logos) is protected under copyright law and is the exclusive property of the Seller. Using this content without the Seller's written consent results in civil and criminal liability.
- The store owner, as the personal data administrator, informs you that:
- providing data is always voluntary but necessary to process the order;

- the person providing their personal data has the right to file a complaint with the Personal Data Protection Office (UODO) if they believe that the processing of personal data related to the order violates the provisions of the General Data Protection Regulation of April 27, 2016.
- Regarding the processing of personal data, the European Commission has not determined an adequate level of protection through a decision, but the data will be appropriately secured using IT/legal solutions and measures.
- Your data will be processed automatically, including in the form of profiling.
